DIAN — Dirección de Impuestos y Aduanas Nacionales — is Colombia's equivalent of the IRS (USA) or HMRC (UK). It is the national agency responsible for collecting taxes and controlling customs. For foreigners living or doing business in Colombia, DIAN is the authority you must understand, respect, and interact with regularly.
What Does DIAN Do?
DIAN is responsible for:
- Collecting national taxes (income tax, IVA, wealth tax, etc.)
- Registering taxpayers (NIT and RUT)
- Auditing businesses and individuals
- Controlling customs and imports/exports
- Enforcing penalties for non-compliance
The NIT: Your Tax ID in Colombia
Every taxpayer in Colombia — individual or company — needs a NIT (Número de Identificación Tributaria). This is the identifier DIAN uses to track all your tax obligations. For individuals, the NIT derives from your cedula (national ID) or passport. For companies, it's assigned upon registration with the Chamber of Commerce.
As a foreigner, to get a NIT you'll need:
- A valid passport or cédula de extranjería
- Proof of address in Colombia
- The RUT form (completed and notarized in some cases)
The RUT: Your Tax Profile
The RUT (Registro Único Tributario) is your tax registration profile at DIAN. It lists your obligations: whether you must file IVA returns, income tax, etc. You must update your RUT anytime your tax situation changes (e.g., you start a business, change address, or become a tax resident).
Key Filing Deadlines for Foreigners
| Obligation | Frequency | Deadline |
|---|---|---|
| Income Tax Return (Renta) | Annual | April–June (by NIT) |
| IVA Return | Bimonthly/Quarterly | Varies by calendar |
| Withholding Tax (Retención) | Monthly | 1st half of following month |
| Exogenous Information | Annual | March–May |
| Wealth Tax | Annual | April–June |
DIAN Penalties: What Happens If You Don't Comply?
DIAN penalties can be severe:
- Late filing: 5% of the tax due per month, up to 100%
- Non-filing: 10% of gross income or assets, whichever is higher
- Underpayment: 50% of the additional tax assessed by DIAN
- Repeat infractions: Possible bank account or asset seizures
Working with DIAN as a Non-Spanish Speaker
All DIAN communications, filings, and systems are in Spanish. This creates a major barrier for English-speaking expats. Working with a bilingual Colombian accounting firm is essential — not just helpful.
Common DIAN Issues for Foreigners
- Failing to update the RUT profile after changing tax status
- Receiving DIAN notifications by email and ignoring them (Spanish)
- Operating as a business without a NIT ("under the table")
- Incorrect declaration of foreign assets
