Colombia has a robust labor protection framework. Hiring employees without fully understanding your obligations can expose your company to significant labor disputes and penalties. This guide breaks down the key requirements for foreign companies employing staff in Colombia.
The Labor Contract (Contrato de Trabajo)
Colombian law recognizes several types of employment contracts:
- Fixed-term (Término Fijo): Up to 3 years, renewable. Employee may not be dismissed before the term ends without legal cause and severance.
- Indefinite-term (Término Indefinido): No end date. Standard for permanent employees.
- Work completion (Obra o Labor): For specific projects.
- Temporary/Apprenticeship: SENA-regulated internship program.
All contracts must comply with the Colombian Labor Code (Código Sustantivo del Trabajo). Verbal contracts are legally valid but risky; always use written agreements.
Minimum Wage
Colombia sets a national minimum wage (Salario Mínimo Legal Vigente — SMLV), updated annually on January 1st. In 2025, the SMLV is approximately COP 1,423,500/month (~USD 345). The minimum transportation allowance (auxilio de transporte) adds another COP 162,000/month for employees earning up to 2x SMLV.
Mandatory Employer Contributions (Parafiscales)
| Contribution | Employer Rate | Employee Rate |
|---|---|---|
| Health Insurance (EPS) | 8.5% | 4% |
| Pension (AFP) | 12% | 4% |
| Occupational Risk (ARL) | 0.52%–8.7% (varies) | 0% |
| SENA | 2% (if > 10 employees) | 0% |
| ICBF | 3% (if > 10 employees) | 0% |
| Caja de Compensación | 4% | 0% |
Total employer cost over and above base salary: approximately 50–60% additional when factoring in mandatory benefits and payroll taxes.
Mandatory Benefits (Prestaciones Sociales)
- Cesantías (severance fund): 1 month of salary per year, deposited annually in February to a fund (Fondo de Cesantías)
- Intereses de Cesantías: 12% annually on the cesantías balance, paid every January
- Prima de Servicios: 15 days of salary in June + 15 days in December (totaling 1 month/year)
- Vacaciones: 15 working days per year (can be taken or paid out)
Electronic Payroll (Nómina Electrónica)
DIAN now requires all employers to issue electronic payroll documents (Documento Soporte de Pago de Nómina Electrónica) for each pay period. These must be generated through DIAN-authorized software and submitted monthly. Non-compliance affects your ability to deduct payroll costs from your corporate income tax.
Hiring Foreigners in Colombia
Foreign employees in Colombia must have a valid visa that permits work (Visa de Trabajo or Visa Mercosur). Pension contributions for foreign workers are treated differently — some visa holders may be exempt from Colombian pension contributions if they contribute to a pension system in their home country (subject to treaty conditions).
